How long will it be before the ‘No fault divorce’ system can be used?
There has been much publicity that parties will now be able to apply for a divorce without having to give a list of reasons against the other party as to why a divorce should be granted. Parties who wished to proceed in as amicable and civilised way as possible breathed a sigh of relief when this was announced. What is the reality though? The reality is that although the Divorce, Dissolution and Separation Bill having received Royal Assent has now become the Divorce, Dissolution and Separation Act, everyone is waiting for this law to be implemented and the new forms and system to be introduced to enable parties to proceed on this basis. Until implementation, the existing archaic system and forms unfortunately need to be used.
